RI Kid’s Consignment Sale Consignor Agreement

This is an agreement between RI Kid’s Consignment, LLC a Limited Liability Company located in the State of Rhode Island and _______________________________________, of __________________________
__________________________________________________________ a Consignor.
In consideration to participate in and profit from the RI Kid’s Consignment Sale, the undersigned Consignor has read, understands, and agrees to the following terms and conditions:
1) Consignor agrees to allow RI Kid’s Consignment Sale to sell any or all items checked into the RI Kid’s Consignment Sale. Consignor has set the price for each item and decided if it will be discounted at the half price sale. The children’s sale will run April 5th & 6th and April 8th & 9th The adult sale will run concurrently. You may begin entering items into the system as soon as you register. Drop off appointments will be available to be chosen on February 1st at 7pm. Volunteer shifts will be open to sign ups on February 12th at 9am. All items must be entered into the Database by noon on Sunday April 2, 2017.
2) RI Kid’s Consignment reserves the right to reject any item that does not meet qualifications or may be inappropriate. Qualifications are available on the website at:http://www.rikidsconsignment.com/ or http://rikidsconsignment.blogspot.com/
We do not accept Car Seats, Mattresses, Breast Pumps, crib bumpers, used crib bedding sets, maternity clothing, open packages of diapers, used bottle nipples or any used silicone items related to bottles or sippy cups, food or formula, recalled items or electronic items that must be plugged into a television. Nor will we take Sophie Giraffe or bathtub toys that squirt or have holes where water can sit and grow mold (unlesst hey are new)
All Socks, Underwear, and bodysuits ie onesies must be new. Consignor understands that items will be inspected at drop off for seasonality, excessive wear and tear, age, damage, missing parts and stains. Children’s clothing must be less than 5 years old. Items determined to be unfit for these reasons will be returned to the consignor at drop off.
If your items are not prepared per our guidelines- you will be required to take them home to fix them and bring them back later in the week.
If 15% or more of your items are rejected, you are limited to consigning 100 items until you have two sales where less than 15% of your items are rejected. THIS DOES NOT APPLY TO FIRST TIME CONSIGNORS.
3) RI Kid’s Consignment agrees to pay Consignor 60% of the total sales amount. You also receive a presale pass. This is increased to 65% for volunteering for 1 shift, 70% for volunteering for 2 shifts, and 75% for volunteering for 3 shifts. Consignor can also work an additional 4th shift for an early presale entry, or can waive one of the 5% from the first 3 shifts for earlier entry to the presale. The greatest percentage available is 75% unless you have a separate written agreement from us. A shift is 4 hours. Prove to me that you read your agreement. Email me the word mermaid who knows you may get a treat. Volunteer shifts will be available for sign up on February 12th 2017 until March 19th 2017
You CANNOT pick a drop off appointment DURING your volunteer shift. You must pick an appointment that is not during your volunteer shift. If you chose a drop off during your volunteer shift you will be removed from your drop off appointment and you will need to pick another drop off appointment based on appointments that remain available. If you are a regular consignor you may become a restocker if no regular drop offs are available. Concessions will not be made if you sign up for a drop off appointment during your volunteer shift.
4) The Consignor understands that there is an $11.00 administrative fee that is paid up front as a registration fee. THIS FEE IS NON-REFUNDABLE. We will not refund if you are unable to or choose not to consign. This goes toward the rental space, advertising costs, and credit card processing fees.
5) The consignor understands that payments will be made within 30 days following the conclusion of the sale. The date for this event is May 9th 2017. All Payments will be made via Paypal.
Physical address and email addresses must be current in your consignor account. Your email address listed in your consignor account must be one that is attached to your Paypal account to receive your consignor proceeds. Please verify this information and make changes as necessary.
6) Consignor fully understands and agrees that items not picked up on Sunday, April 9th, 2017 prior to 7:30 pm will become the property of RI Kid’s Consignment and may be donated to a nonprofit charity. Items cannot be held after 7:30pm on April 9th 2017. A $25 fee will be incurred by the consignor If items not marked donate are not picked up by the 7:30pm deadline.
7) Consignor agrees that items checked in to RI Kid’s Consignment Sale must meet the following criteria or be subject to removal/disposal:
Tagged with a bar coded card generated by the MySaleManager.net software
Prepared according to the guidelines on the website (www.rikidsconsignment.com or http://rikidsconsignment.blogspot.com/) including wire hangers, white cardstock, etc.
Meet current requirements of the Consumer Product Safety Commission (CPSC) and may not be included on any list of recalled items, contain any hazardous material or exceed lead standards of 100 parts per million (ppm). Consignors must check the following websites to ensure that they are in compliance;

Items must be dropped off during your scheduled drop off appointment. Drop off appointments are available on a first come first serve basis. You may sign up for a drop beginning Februrary 1st at 7pm
8) Consignor agrees that if they check the half price box in the consignment software that their items will be sold for 50% off on the final morning of the sale, April 9th 2017. If the box is not checked their item will still be available, the final morning for full price. Consignor understands that they can pick and choose which items they allow to go half price and which they don’t. Any items marked for Donate must be marked for discount.
9) Consignor agrees that items that they mark Donate in the consignment software will be donated to a non-profit charity on their behalf. Consignor will receive a receipt for their donation. Consignor understands that items they check to be donated will not be available for pick up and cannot be retrieved. ANY ITEM MARKED FOR DONATE, WILL AUTOMATICALLY MARK FOR DISCOUNT. Please print your donation report once all the files have been uploaded after the sale. If an item passes inspection but is later determined to be ripped, stained or damaged and the items is marked discount RIKC reserves the right to sell that item at 50% off prior to the half price day. This will be at the sole discretion of the owner.
10) Consignor understands that there is a limit on the number of certain items brought for the sale:
There is a limit of 25 items (sets) in each of the following size ranges: 0-3 months, 3-6 months, 6-12 months, 12-18 months, 18-24 months. 1 item/set per hanger. A set MUST be the same brand and size. Size 3 months should be entered as 0-3, size 6 months as 3-6 months, and 9 or 12 months or 6-9 months is 6-12 months. No limit on Preemie. (RESTOCKING CONSIGNORS are EXEMPT from these LIMITS)
Size 12 and up clothing must be no more than 3 years old and must be mall brands or better (ie. abercrombie, american eagle, aeropostale, etc.)
Womens and Mens clothing will be no more than 5 years old, all brands are excepted there is a limit of 30 adult items total (including clothing, shoes, books, etc.)
Restocking Consignors
10a)Restockers have no item limits on restricted sizes.
Restockers may bring up to 75 adult items
Restockers may also bring in body suits, pants and tops, dresses for dollar bins. You must use the Dollar Bin Body Suit, pant and top category, all items must be $1 and marked discount and donate.
Restockers will pay a reduced consignor fee of $8
items must be entered into the database by 11:59am April 2nd 2017
11) You have one week to dispute items. No disputes will be considered after April 16th 2017.
12) RI Kid’s Consignment Sale agrees to exercise reasonable care to ensure that all items checked into the sale are not damaged, stolen, or misplaced. Any items found without a tag during the sale will be placed in the Lost and Found area. Consignors should check the lost and found area during the scheduled pickup time for any misplaced items. RI Kid’s Consignment will not assume liability or be held responsible for Consignor’s items lost, stolen, or damaged. Any items not claimed from the Lost and Found will be donated. We do not make reimbursements for any lost, stolen, or damaged items.
13) Consignor agrees to hold harmless and make no claim against RI Kid’s Consignment, Mary-Lyn Siderski, any volunteers, any fellow consignors, or the event venue Wide World of Indoor Sports South for the damage, theft or loss of any items consigned to RI Kid’s Consignment Sale. Consignor assumes the risk of these events occurring by participating in the sale.
14) Consignor agrees to waive any and all claims for personal injury resulting from participation in the sale.
15) Seller agrees not to set up in business as a direct competitor of RI Kids Consignment, LLC, within a 35 mile radius, for a period of 24 months or 2 years. This includes any form of consignment based business.

1) Consignor agrees to allow RI Kid’s Consignment Sale to sell any or all items checked into the RI Kid’s Consignment Sale. Consignor has set the price for each item and decided whether or not it should be discounted at the half price sale. The children’s sale will run April 27th & 28th 2016 and April 30th and May 1st 2016. The adult sale will run concurrently..

RI Kid’s Consignment will not assume liability or be held responsible for Consignor’s items lost, stolen, or damaged. Any items not claimed from the Lost and Found will be donated. We do not make reimbursements for any lost, stolen, or damaged items.
12) Consignor agrees to hold harmless and make no claim against RI Kid’s Consignment, Mary-Lyn Siderski, any volunteers, any fellow consignors, or the event venue Wide World of Indoor Sports South for the damage, theft or loss of any items consigned to RI Kid’s Consignment Sale. Consignor assumes the risk of these events occurring by participating in the sale.
13) Consignor agrees to waive any and all claims for personal injury resulting from participation in the sale.
14) Consignor agrees to cash their consignment proceeds check within 60 days of receipt.

the sale.
14) Consignor agrees to waive any and all claims for
personal injury resulting from participation in the sale.
15) Consignor agrees to cash their consignment proceeds
check within 60 days of receipt.
16) Seller
agrees not to set up in business as a direct competitor of RI Kids Consignment,
LLC, within a 25 mile radius, for a period of 24 months or 2 years.
